These rules define the principles of selling products by auction (hereinafter: "Auction") in the online store fluo.dog.
In matters not regulated in this document, the provisions of the main Store Regulations and applicable Polish law shall apply.
The organizer of the Auction is the owner of the fluo.dog store.
The basic currency for transactions in the store is the Polish Zloty (PLN). However, the Auction System allows participation in the auction using foreign currencies (EUR, USD), under the terms specified in Ā§ 3 of these Regulations.
Ā§ 2. Conditions of participation
Participation in the Auction is voluntary.
Only Registered Users are entitled to participate in the auction, who:
have an active account in the fluo.dog store,
are logged in at the time of placing the bid.
By entering the auction, the User declares that they have read these Regulations and fully accept its terms.
Ā§ 3. Course of the Auction, Currencies and Bidding
The subject of the Auction are goods indicated by the Seller, marked with a timer and a starting price.
Placing bids:
The auction takes place by entering the amount and confirming the bid with the bidding button.
Each new bid must be higher than the currently highest bid visible on the product page.
Placing a bid is a legally binding commitment to purchase the goods in case of winning.
The system does not allow the User to withdraw or cancel a submitted bid.
Currency handling and exchange rate differences:
The User has the option to bid in PLN, EUR, or USD, according to the settings of their store view.
Bids placed in foreign currencies (EUR, USD) are automatically converted by the system to the base currency (PLN) to determine the ranking of bidders.
The User acknowledges and accepts that due to currency conversion mechanisms and system rounding, the final amount to be paid in foreign currency (EUR/USD) may slightly differ from the amount declared in the bid.
Any minor differences in the final price resulting from currency conversions do not constitute grounds for a complaint about the product price.
āOvertimeā mechanism (Anti-Sniping):
If any bid is placed within the last 60 seconds before the scheduled end of the Auction, the time until its end is automatically extended by another 60 seconds.
The extension of time continues until no new bid surpassing the current price is placed within the last 60 seconds.
Ā§ 4. Winning and Ending the Auction
The winner of the Auction is the User who offered the highest amount at the moment of its final conclusion.
After the Auction ends, the item is technically blocked for all other buyers. The right to purchase and add the product to the cart belongs exclusively to the Winner's account.
The Winner receives a notification of their win along with instructions for finalizing the purchase.
Ā§ 5. Finalizing the transaction (Payment and Delivery)
The Winner of the Auction is obliged to finalize the transaction, which is understood as:
adding the auctioned product to the cart,
choosing the form of delivery and payment,
paying for the order.
The Winner has 7 days from the moment of the Auction's conclusion to finalize the transaction.
After the unsuccessful expiration of the 7-day period:
The Winner loses the right to exclusivity in purchasing the goods at the auctioned price.
The Seller has the right to relist the goods for auction or for regular sale.
The Seller reserves the right to block the account of a User who frequently wins auctions and does not pay for orders.
Ā§ 6. Returns and Complaints
Products purchased through the Auction in the fluo.dog store are subject to standard complaint procedures.
A consumer who made a purchase through the Auction has the right to withdraw from the contract within 14 days without giving a reason, unless the subject of the service is a non-prefabricated item made according to the consumer's specifications (e.g., a personalized product).
